1. Identity and scope

MindTab is a pre-incorporation software business project operated by Marco Gudiño in Galway, Ireland. These terms govern use of the public corporate website at mindtab.ie and its public content.

They do not replace any later SaaS subscription agreement, order form, Data Processing Agreement, Service Level Agreement or product-specific terms for MindTab PMS, MindTab POS or MindTab Guests.

2. Acceptance and lawful use

By browsing the website, you agree to use it lawfully and not interfere with its security, availability, content, forms or infrastructure. You must not attempt unauthorised access, submit malicious code, scrape abusively or misrepresent your identity.

3. Website information

The website describes MindTab products and commercial intentions for hospitality businesses. Content is provided for general information and may change. Demo, trial, pricing or subscription information shown on the website does not guarantee availability or create a contract by itself.

4. Enquiries, demos, trials and purchases

Submitting an enquiry, demo request, pilot application or onboarding request allows MindTab to respond. A contract is formed only when separately agreed. If the product ecosystem offers self-service trials or subscriptions through mindtabpms.com, those flows may require their own approved SaaS terms, cancellation terms, refund rules and data-processing agreement.

5. Intellectual property

MindTab branding, product names, text, visual design, screenshots and website content belong to the operator or licensors unless stated otherwise. You may not copy, resell or present the website or product materials as your own.

6. Third-party links and services

The website links to mindtabpms.com and may load YouTube videos after consent. Third-party services are governed by their own terms and policies.

7. Availability, changes and restriction

MindTab aims to keep the website available but does not promise uninterrupted access. The operator may change content, suspend abusive access or restrict activity that harms the website or other users.

8. Liability

Nothing in these terms excludes liability where exclusion would be unlawful, including mandatory statutory rights. To the extent permitted by Irish law, MindTab is not responsible for indirect loss arising from use of the public website or reliance on non-binding website information.

9. Privacy and cookies

Personal data and browser storage are handled as described in the Privacy Policy and Cookie Policy.

10. Legal terms

If any part of these terms is invalid, the rest remains effective. Failure to enforce a term is not a waiver. These terms are governed by Irish law and the Irish courts, without removing mandatory protections that may apply to consumers or other protected parties.
